           As the season of giving approaches, we want to share a story of hope and need from a community fighting for safe passage every single year.

            For months, members of The Primestone Group have volunteered their time alongside Engineers Without Borders DC to tackle a problem in the rural village of Dumangbe, Sierra Leone. Pro bono services provided included expert cost estimating and contract review services for the design of a permanent and resilient bridge.

           Imagine a village that watches its lifeline disappear under raging water year after year. Every rainy season, the floods return, cutting off Dumangbe's children from their schools, isolating the sick from vital hospitals, and preventing families from reaching essential markets. It's a terrifying disruption to life, health, and opportunity.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           In April 2026, Shantel Evans, The Primestone Group's President will be boots on the ground, traveling to Dumangbe to help with the physical construction and pouring of the culvert.

All estimates should include a documented line item for escalation for budget purposes.

This should be based upon a known index and methodology for implementation. If a claim is made for escalation costs then this needs to be supported in terms of initial pricing back up, back up to establish a reasonable pricing uplift and a clear contract clause that allows this type of claim to be submitted in good faith.

      &lt;/span&gt;&#xD;

             In some circumstances it may make economic sense to pre-purchase materials ahead of the project schedule requirements. By doing so the storage costs need to be factored into the cost equation but by buying ahead there may be savings in terms of escalation costs and preventing project delays.

        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;

            new workers in 2025 to meet current demand.

             Wages have risen

           4.5%

            over the past 12 months, and productivity is sliding as firms scramble to train replacements on the fly. Apprenticeships are down. However, with the Executive Order announced on April 23, there is a fresh Federal push to expand registered apprenticeships across high-demand industries, including construction.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The goal?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            ●     
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           1 million new active apprentices
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            nationwide
            &#xD;
        &lt;br/&gt;&#xD;
        
             
            &#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;

           Potential support for both union and non-union training pathways

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           It is a smart move, but even if fully successful, these programs will take years to materially impact the workforce shortage we are seeing today. It takes time to source and train productive workers, especially in complex trades such as mechanical and electrical. Costs will still have to reflect low labor productivity and lack of skilled workers.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Labor gaps or shortages will require premiums to be added to reflect low productivity, added supervision, training costs, added health and safety requirements and prolonged schedules with associated cost to critical activities. We are also seeing scheduling impact charges, rush premiums, padded contingencies all driven by labor gaps.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
             
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           3. What This Means for Project Costs and Planning
          &#xD;

           The ripple effects are immediate and real:

           Risk pricing is baked in:

            Contractors are submitting more conservative bids because they know volatility and higher labor costs are here to stay.
            &#xD;

    &lt;/span&gt;&#xD;

            I recently had the opportunity to attend the

           ABA Forum on Construction Law's 2025 Annual Meeting
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            in Austin, Texas. This meeting is always a highlight. The primary focus was on the critical issues facing contractors in today's market, and the sessions were incredibly informative.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           A major takeaway for me was the emphasis on pre-construction services. It's clear that these services are no longer just a nice-to-have; they're essential for the success of modern construction projects. The panelists provided valuable insights into best practices, the importance of clear communication, and the challenges involved in this crucial phase.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The meeting also featured a wide range of other relevant topics, including productivity and disruption claims, subcontractor relations, surety issues, and delegated design management. The content was top-notch, and I left with a wealth of knowledge to apply at The Primestone Group.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

           But beyond the educational value, what truly struck me about this conference was the atmosphere. It seemed less like a formal conference and more like a reunion of old friends. Many of the attendees have been involved with the ABA Forum on Construction Law for a long time, and catching up with familiar faces is always a pleasure. For me, it was more than just a professional gathering; it was a chance to reconnect with people I've known and respected for years. Seeing familiar smiles, shaking hands with colleagues who have become friends, and feeling the warmth of this close-knit community of lawyers was truly special. The whole experience was incredibly inviting.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In addition to the sessions, the conference provided ample networking opportunities. I connected with colleagues from across the country, as well as vendors and experts in the construction industry. These connections are invaluable, and I'm grateful for the chance to have made them.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The 2025 Annual Meeting was more than just a conference; it was an experience. I came away with new knowledge, valuable connections, and a renewed sense of enthusiasm for my work in construction law. I'm already looking forward to the next one!

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           While political debates rage on, here’s what really matters for A/E firms, contractors, and project owners: pricing strategies and claims just got messy.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           If you're in the middle of cost estimating for federal projects stop and re-check your assumptions.
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Labor costs are no longer locked to $17.75. On paper, you can now revert to contract wage determination rates, but should you? If you continue paying at the higher rate, will the government honor pending price adjustment requests tied to the now-revoked EO 14026? Or will they stall, leaving contractors holding the bag? Clarification is required.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           If you prepare your estimate using lower wage rates and the change in law gets rescinded what will the outcome be on bid day?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           Project owners: buckle up.
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If you’re working with service or construction contractors, this shift will ripple into your cost baselines. Claims are coming not later, but now.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Contractors who budgeted around EO 14026 will likely seek equitable adjustments or dispute denied price adjustments-the contract might not cover downward price adjustments, however best to check. Expect increased audits, more claims consulting work, and tough conversations about fair compensation versus legal obligation. Depending on your current contract agreements you may not realize any savings. Contractor’s may claim the change in law prevented adequate staffing being available-one of many possible arguments.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           A/E Firms: This changes your forecasting immediately.
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Cost estimators can’t rely on last quarter’s assumptions. Pricing inputs need to reflect this new reality but also anticipate market reluctance to lower wages overnight. Many contractors won’t reduce rates out of fear of losing labor, especially in a still-tight construction labor market. The result? Estimates that don’t align with real bid pricing, leading to unexpected deltas. As with multiple changes to tariffs will this latest change of law be rescinded at some point.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           One more thing (and it’s a big one):
          &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            We’ve been asked if this only impacts private contracts. The answer: no. This applies to certain
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            federal
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            service and construction contracts covered by the Davis-Bacon Act (DBA) and Service Contract Act (SCA). The DBA and SCA set wage floors for specific trades and classifications, but EO 14026 required contractors to pay the
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           higher
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            of those wage determinations or the EO minimum wage. Now that EO 14026 is revoked, contractors are no longer required to pay above those DBA or SCA rates unless they choose to for labor retention.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Most trade classifications according to Davis-Bacon schedules are above the $17.75 level however it depends on the geographic location and the construction labor classification. We suggest a quick review of any current Davis-Bacon schedules that may be applicable to your specific project type and location. If the project is weighted towards unskilled labor, then the impact to your project needs to be reviewed.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
